A IMPORTÂNCIA DA AUDIÊNCIA DE CUSTÓDIA NAS PRISÕES PREVENTIVAS

A pesquisa aborda o tema da audiência de custódia, desde sua origem até sua implementação no sistema legal, bem como a sua importância dentro do ordenamento jurídico brasileiro quando se trata do dispositivo da prisão preventiva. O objetivo deste artigo é esclarecer tanto teoricamente quanto na prática o inovador conceito da audiência de custódia, que representa um marco significativo na busca por uma justiça mais ágil para a sociedade. Portanto, iremos analisar tanto a aplicação teórica quanto prática contida neste estudo, que fornecerá uma compreensão doutrinária, bem como o estreito laço que gera impacto na esfera social quando se trata de aplicações do judiciário. Isso beneficia não apenas o sistema judiciário, mas também a sociedade como um todo, com ênfase especial no acusado, resultando em uma apreciação mais rápida das demandas apresentadas perante o judiciário.

The research addresses the subject of the custody hearing, from its origin to its implementation in the legal system, as well as its importance within the Brazilian legal system when it comes to the provision of preventive detention. The purpose of this article is to clarify both theoretically and in practice the innovative concept of the custody hearing, which represents a significant milestone in the search for a more agile justice for society. Therefore, we will analyze both the theoretical and practical application contained in this study, which will provide a doctrinal understanding, as well as the close bond that generates impact in the social sphere when it comes to judiciary applications. This benefits not only the justice system, but also society as a whole, with a special emphasis on the accused, resulting in a faster appreciation of claims brought before the judiciary.
